Beer Guppy™ Terms and Conditions of Use Agreement (Updated 05/25/2009)

Jay Sheveck, dba Beer Guppy™ (herein "Jay Sheveck", "Beer Guppy", "us" or "we"), is a multimedia production and publishing company based in Burbank, Calif., dedicated to promoting all things beer. BeerGuppy.com is Beer Guppy's official virtual storefront, and BeerPioneers.com is the official Web site of our upcoming documentary Beer Pioneers™, directed by Jay Sheveck.

Beer Guppy produces and publishes: books, magazines, electronic publications, software, films, videos, DVDs, videocassettes, podcasts, streaming media, audio recordings and published articles (collectively herein "Products"); and also provides services including: ad content, ad copy, publicity services, production services, new media publishing services, and miscellaneous media services (collectively herein, "Services"). Beer Guppy also owns/controls Internet domains, Internet portals and Web sites which include, but are not limited to, www.BeerGuppy.com and www.BeerPioneers.com (collectively herein "Web Site"); all content, information and tools on the Web Site created by Beer Guppy (herein "Web Site Content") is covered by this agreement.

Acceptance:

By using the Web Site, Web Site Content and the Products and Services offered on the Web Site, you agree to follow and be bound by these terms and conditions and the Sales Policy and the Privacy Policy which are hereby incorporated by reference. If you do not wish to be bound by these terms and conditions, the Sales Policy and the Privacy Policy, you may not access or use this Web Site and the services offered on the Web Site.

This Terms and Conditions of Use Agreement (herein "Agreement") applies to all visitors to any Beer Guppy owned and/or controlled Web Site.

Limitation of liability:

To the extent legally permitted under applicable law, Jay Sheveck, dba Beer Guppy, shall not be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including any lost profit damages arising from your use of the products or services, even if Beer Guppy has been advised of the possibility of such damages.

Notwithstanding anything to the contrary contained herein, Beer Guppy's liability to you for any damages arising from or related to any cause of action whatsoever, regardless of the form of the action, shall be limited to the greater of twenty US dollars ($20), or the amounts you paid to Beer Guppy in the six (6) months prior to the accrual of the claim. Nothing in this agreement shall limit or exclude Beer Guppy's liability for gross negligence or intentional misconduct of Beer Guppy or its agents or employees, or for death or personal injury.

Our Web site is for entertainment use only and contains content of an adult nature (i.e. consumption of alcohol and similar adult drinking themes, etc.) which you accept freely and willfully. You certify that you are of legal age to use this Web site in the United States and, if applicable, in the country that you are in. You accept full responsibility for any and all actions, liabilities, damages or consequences resulting from: your use/abuse of any type of alcoholic beverage; and/or, your use of the product(s) and/or the service(s) relating to any advertisement placed on this Web site, which includes your use of any external link to a Web site that is not controlled or owned by Beer Guppy. If at any time part of this agreement is deemed unenforceable by any court of law, then all other sections shall remain in full effect. Only Jay Sheveck has the right to change these terms and conditions, which may be done so at his sole discretion, at any time and for any reason. If you make a purchase on this Web site, all sales are strictly governed by our sales policy, which is viewable elsewhere on this Web site. Everything preceding and herein (including all information) is subject to change without notice. You freely and willfully agree to all of these terms in consideration for the temporary and limited "access and usage" of this Web site, and use at your own risk.

Release:

You hereby release Beer Guppy, its owners, officers, employees, agents and successors from claims, demands any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, that is either directly or indirectly related to or arises from any interactions with alcohol, and/or the use of any Products, Services, Web Site, and/or Web Site Content, in connection with this Web site.

Web Site Content License

You agree not to use the Web Site or the Web Site Content for commercial purposes. All Web Site Content is the proprietary property of Beer Guppy, or its licensors, with all rights reserved. No Web Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without Jay Sheveck's prior written permission. You are granted a limited license to access and use the Web Site and the embeddable player solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. Except via inclusion of the embed links explicitly provided in the Web Site, you may not republish Web Site Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Web Site Content is strictly prohibited. Any use of the Web Site or the Web Site Content other than as specifically authorized herein, without the prior written permission of Jay Sheveck, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in this Agreement shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time without notice and with or without cause.

All other trademarks, logos and businesses identities not owned by Beer Guppy are the property of their respective owners. Beer Guppy (Web Site included) is not an official representative of said companies/persons.
