Beer Guppy™ Sales Policy (Updated 07/10/2007)

1. Retail Purchases and Purchases Conducted Via Our Web Site (www.BeerGuppy.com)

Beer Guppy™ conducts all retail sales according to the following terms:

1. All sales are final.
2. California residents and California delivery addresses must include 8.25% sales tax
3. Payments must be made in U.S. Funds, no exceptions.
4. Please allow up to ten (10) days for your order to be processed from our receipt of order (i.e. clearance of checks, etc.).
5. No refunds, however merchandise may be returned for even-exchange if damaged in transit or if physically defective. This may be done so only within seven (7) days of the shipping date/postmark on the original package.
6. Notify Beer Guppy™ via e-mail prior to making a return for exchange. Determination for qualifying a return for exchange will be made at Beer Guppy™'s sole discretion.
7. Purchases made through PayPal® will be considered "final" upon delivery of merchandise as described by shipper's package tracking method showing "a delivery."
8. Foreign orders are considered to be orders placed (and/or are shipped to) anywhere outside of the contiguous United States, including Alaska and Hawaii. Foreign orders pay the posted "Canadian price"* and $3.50 shipping per item. Sorry, foreign orders may not use PayPal® at this time. (* Currently, The Beer Guppy's Guide to Southern California is retail priced at $9.95 / United States and $12.95 / Canada)
9. Large orders (generally consisting of ten (10) or more units) may qualify for a discounted postage rate, inquire via e-mail before placing order.

2. Wholesaler & Distributor Terms and Conditions

Beer Guppy™ conducts all wholesale and distributor sales according to the following terms:

Qualification

A copy of your retail license (resale certificate) must be on file prior to placing your wholesale order.

Ordering

1. No minimum order necessary.
2. Orders may take up to 10 working days to fulfill.
3. All sales are final, except for consignment sales
4. Merchandise is sold AS-IS.
5. We do not accept cancellation after order confirmation.

Billing

1. Terms are net 30 days.
2. All delinquent accounts will incur a 1.5% per month service charge (18% / annum).

Shipping

1. Shipping and/or delivery charges are included in total price for orders of ten (10) units or more.
2. A flat $6.00 service charge is applied to all single orders under ten (10) units.
3. Shipments will be made via USPS, UPS, FedEx or local delivery service from Burbank, California; our choice.

Title

1. The exchange of title of ownership for any merchandise sold is established upon the acceptance of the shipping company in the State of California .

Returns

1. No returns, unless mutually agreed to by all parties in writing prior to sale.
2. Shipping and handling fees are non-refundable.

Fair Pricing

1. In the best interest of all of our clients, we ask that you not underprice the retail value of the guide (e.g. eBay, Web sites, etc.). It is not fair to the other clients who purchase our products at wholesale with the intent of selling them at the regular retail price.
2. Wholesale prices are confidential.
3. Wholesale prices may be subject to change without prior notice.

Changes and/or Additional Terms

1. Updates, additions and/or modifications to these terms and conditions may be made without notice, at any time, and for any reason, only by Jay Sheveck and at his sole discretion.
2. Refer to your most recent invoice for all other terms of sale.
